The terms that govern use of this website and engagements with PowerX Global.
By accessing this website or engaging PowerX Global for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or services.
PowerX Global provides software development, ERP/POS implementation, AI/ML engineering, and green-energy infrastructure services under separate signed statements of work (SOWs). These general terms govern the website; project-specific terms are set out in each SOW.
Unless otherwise agreed in a signed SOW, deliverables created specifically for a client under a paid engagement transfer to the client upon final payment. Pre-existing tools, frameworks, and internal libraries used to build deliverables remain the property of PowerX Global and are licensed to the client for use with the deliverable.
Project payment schedules are defined per SOW, typically milestone-based. Invoices are due within 14 days unless otherwise agreed. Late payments may pause active development until resolved.
Delivered software includes a 90-day defect-correction warranty from acceptance, covering bugs in delivered functionality. Ongoing support, feature work, and SLAs beyond the warranty period are covered under separate support agreements.
To the extent permitted by law, PowerX Global's total liability for any claim arising from services is limited to the fees paid for the specific engagement giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
Either party may terminate an active SOW with 30 days' written notice. Client remains responsible for payment of work completed and committed costs up to the termination date.
These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Disputes will first be attempted to resolve through good-faith negotiation before formal proceedings.
